Welcome to The Stick Chick FL. These Terms & Conditions (“Terms”) govern your use of our website, mobile phlebotomy services, and any related communications or scheduling platforms operated by The Stick Chick FL (“Company,” “we,” “our,” or “us”).

By scheduling an appointment, using our services, or accessing this website, you acknowledge that you have read, understood, and agreed to these Terms.

1. Mobile Phlebotomy Services

The Stick Chick FL provides mobile phlebotomy and specimen collection services in which a trained phlebotomist travels to a patient’s home, office, assisted living facility, or other approved location to collect blood and/or other authorized laboratory specimens.

Our mobile service is offered solely for patient convenience and is optional. Patients may alternatively choose to visit a traditional laboratory or medical facility for specimen collection.

The mobile concierge service requires an additional fee that varies depending on:

• Type of service requested
• Appointment location
• Travel distance
• Appointment timing
• Special handling requirements
• After-hours or expedited requests

Service fees are disclosed prior to confirmation of the appointment.

2. Appointment Scheduling & Non-Refundable Deposit

A $50 non-refundable deposit is required at the time of scheduling in order to reserve an appointment.

By scheduling an appointment, you acknowledge and agree that:

• The deposit secures the appointment time and mobile travel reservation
• The deposit is non-refundable under all circumstances, including cancellations, missed appointments, rescheduling requests, inability to obtain laboratory orders, or refusal of service at the appointment location
• The deposit may be applied toward the total balance due for the scheduled service
• Remaining balances are due at the time services are rendered unless otherwise agreed in writing

The Company reserves the right to cancel or refuse appointments that have not been properly secured with payment.

3. Cancellations, Rescheduling & No-Show Policy

Patients are encouraged to provide at least 24 hours’ notice for appointment changes.

The Stick Chick FL reserves the right to charge additional fees for:

• Same-day cancellations
• Excessive rescheduling
• Missed appointments
• Patient unavailability at the scheduled location
• Incorrect address information
• Delays exceeding 15 minutes

Failure to appear for a scheduled appointment may result in forfeiture of all fees paid.

4. Medical Orders & Patient Responsibility

Patients are responsible for obtaining valid laboratory orders, requisitions, or physician authorizations when required by law or laboratory policy.

The Stick Chick FL does not diagnose medical conditions, interpret laboratory results, prescribe treatment, or provide medical advice.

Patients acknowledge that:

• Laboratory testing is performed by independent laboratories
• The Company’s role is limited to specimen collection and handling
• Patients should consult their physician or healthcare provider regarding all medical concerns and laboratory results

5. Consent to Blood Draw & Specimen Collection

By scheduling or receiving services, the patient voluntarily consents to specimen collection procedures including venipuncture, capillary blood collection, and related phlebotomy procedures.

Patients understand and acknowledge that blood collection procedures may involve inherent risks including, but not limited to:

• Bruising
• Bleeding
• Infection
• Hematoma
• Dizziness
• Fainting
• Nerve irritation
• Allergic reactions
• Discomfort at the puncture site

While The Stick Chick FL follows industry-standard safety and infection-control protocols, no medical procedure is entirely risk-free.

Patients agree to immediately disclose any:

• Blood disorders
• Communicable diseases
• Allergies
• Prior adverse reactions
• Fainting history
• Medication use, including blood thinners

6. Handling of Blood & Biohazardous Materials

The Stick Chick FL adheres to applicable federal, state, and local regulations regarding the collection, handling, transportation, storage, and disposal of blood and bodily fluids, including applicable:

• OSHA Bloodborne Pathogens Standards
• CDC infection-control recommendations
• HIPAA privacy requirements
• Florida healthcare and laboratory regulations

All specimens are treated as potentially infectious biohazardous materials and are handled using universal precautions and appropriate protective measures.

Patients acknowledge and agree that:

• Blood and bodily fluid specimens may be transported to third-party laboratories for testing
• Specimens may be rejected by laboratories due to improper labeling, clotting, insufficient volume, contamination, delayed transport, or other circumstances beyond the Company’s control
• Additional collection fees may apply if recollection is required

The Company reserves the right to refuse service if an environment is determined to be unsafe, unsanitary, hostile, or otherwise inappropriate for specimen collection.

7. HIPAA & Patient Privacy

The Stick Chick FL is committed to protecting patient privacy and confidential health information in accordance with applicable laws, including the Health Insurance Portability and Accountability Act (“HIPAA”).

By using our services, patients consent to the collection, use, transmission, and storage of information necessary to:

• Schedule appointments
• Verify identity
• Coordinate laboratory services
• Process payments
• Communicate regarding healthcare services
• Comply with legal obligations

Protected health information is only shared as permitted or required by law.

8. Payment Terms

Payment is due at the time of service unless otherwise agreed upon in writing.

Accepted payment methods may include:

• Credit cards
• Debit cards
• Electronic payments
• Other approved forms of payment

Patients are responsible for all:

• Service fees
• Travel fees
• After-hours fees
• Redraw fees
• Returned payment fees
• Collection costs arising from unpaid balances

Insurance reimbursement, if applicable, remains the sole responsibility of the patient unless otherwise specified.

9. Limitation of Liability

To the fullest extent permitted by law, The Stick Chick FL, its owners, employees, contractors, affiliates, and representatives shall not be liable for:

• Indirect damages
• Incidental damages
• Consequential damages
• Delays caused by traffic, weather, or laboratory processing
• Laboratory errors
• Loss of specimens by third parties
• Medical complications unrelated to negligence
• Inaccurate or incomplete information provided by patients

The Company’s total liability arising from any service shall not exceed the amount paid by the patient for the specific appointment giving rise to the claim.

10. Refusal of Service

The Stick Chick FL reserves the right to refuse or terminate services at any time for reasons including, but not limited to:

• Unsafe conditions
• Threatening behavior
• Unsanitary environments
• Lack of valid identification
• Lack of required laboratory documentation
• Suspected fraud
• Non-payment
• Situations outside the scope of service

11. Website Use

All content on this website, including text, branding, logos, graphics, and materials, is the property of The Stick Chick FL and may not be copied, reproduced, or distributed without written permission.

Users agree not to:

• Use the website for unlawful purposes
• Attempt unauthorized access to systems
• Interfere with website functionality
• Submit false or misleading information

12. Indemnification

You agree to indemnify, defend, and hold harmless The Stick Chick FL and its affiliates from any claims, damages, liabilities, losses, costs, or expenses arising from:

• Your use of the services
• Violation of these Terms
• Inaccurate information provided by you
• Failure to follow medical instructions or preparation requirements

13. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the appropriate courts located within the State of Florida.

14. Changes to These Terms

The Stick Chick FL reserves the right to update or modify these Terms & Conditions at any time without prior notice. Updated versions will become effective upon posting to the website.

Continued use of the website or services constitutes acceptance of the revised Terms.
